Dear DeviantART,

After having my entire gallery censored indiscriminately, and being continually ignored, the natural course of action obligated me to contact the Help Desk. I've emailed to you, several key evidences, that I am in fact in the process of "Manifesting Religion."

I've clearly outlined my unique situation and delicate legal case. It is not my intent to "spam" the Help Desk, but to find someone with common decency and respect, who bothers to take me seriously. Someone who does not presume me to be an idiot or who assumes out of ignorance to International Law, that I am guilty of some crime I did not commit.

Damphyr stated that my access has been suspended, without even carefully reviewing the ticket. My Gallery should be studied, not censored. This is not the Help I seek from the Help Desk. 

The issue in question falls under the protections afforded to me in the realm of Public Domain. I screen shoot public domain works, take my own photographs and incorporate the Mixed Media into hybrid Derivative Works, preserving Traditional Knowledge while expressing my Political Statement. The "models/photographers" you question could not claim control over Copyright and as such the Derivative Works became directly protected by United States Law, when I incorporated them into my gallery. Therefore the images were either considered "fair use," or were directly contracted by Palaestra Gems International, screen shot, sourced from the public domain, or were images directly entrusted to me by the models without contracts. 

Furthermore, PUBLIC images are ineligible for copyright, unless incorporated directly into protected WIPO Derivative Works, as per my unique panoramic political statement. Familiarize yourselves with my file. Do your due diligence.

NO ONE can claim control over the distribution and usage of my Gallery BUT ME. Therefore, I hold the right to manipulate, distribute, sell, or otherwise utilize these works, "without legal ramifications."

Section 104 of the Copyright Act establishes the conditions of eligibility for protection under U.S. law for works from other countries. Section 102(b) of the DMCA amends section 104 of the Copyright Act and adds new definitions to section 101 of the Copyright Act in order to extend the protection of U.S. law to those works required to be protected under the WCT and the WPPT.

I agree. But Suppressing Freedom of Speech & Expression is fascist and Illegal, while legitimate Derivative Art is Copyright protected by U.S. And International Law.

This is a legal opinion from some LawGroup. Not fact.

Face it, DeviantART Administrators have bullied me out of a bonafide U.S. & Internationally Copyright Protected Visual Art Gallery. People are quick to judge and claim self righteousness, even though I am innocent until proven guilty.

I've been lynched without a trial.

According to WIPO (World Intellectual Property Organization), my entire Visual Art Gallery is protected both by U.S. Law and by International Treaty, respectively.

Preamble

The Contracting Parties (United States included),

    Desiring to develop and maintain the protection of the rights of authors in their literary and artistic works in a manner as effective and uniform as possible,

    Recognizing the need to introduce new international rules and clarify the interpretation of certain existing rules in order to provide adequate solutions to the questions raised by new economic, social, cultural and technological developments,

    Recognizing the profound impact of the development and convergence of information and communication technologies on the creation and use of literary and artistic works,

    Derivative Work - Legal Definition.

    In copyright law, the term “derivative works” refers to the translations, adaptations, arrangements and similar alterations of preexisting works which are protected under Article 2(3) of the Berne Convention for the Protection of Literary and Artistic Works (1971) as such without prejudice to the copyright in the preexisting works. Sometimes, the term is used with a broader meaning, extending to the compilations/collections of works protected under Article 2(5) of the Convention, (as well a under Article 10.2 of the World Trade Organization (WTO) Agreement on Trade Related Aspects of Intellectual Property Rights, 1994 (the TRIPS Agreement), and Article 5 of the WIPO Copyright Treaty, 1996 (WCT)).     Some jurisdictions have adapted the definition of derivative works in the field of traditional cultural expressions. According to the Pacific Regional Framework for the Protection of Traditional Knowledge and Expressions of Culture (2002), the term refers to any intellectual creation or innovation based upon or derived from traditional knowledge or expressions of culture.
